1. Acceptance of Terms

By accessing demo-apex.dealerapex.ai, contacting Apex Motors, submitting an inquiry, applying for financing, or purchasing a vehicle from us, you agree to these Terms and Conditions ("Terms"). If you do not agree, please do not use our website or services.

4. Vehicle Inventory, Pricing, and Availability

Vehicles displayed on our website are subject to prior sale. Vehicle photos may be representative and not exact.

Advertised prices reflect the vehicle sale price only and do not include state sales tax, title, registration, or documentary preparation fees where applicable. Any additional dealer fees will be itemized on your purchase order before you sign. You may review the itemized fee list at either dealership location or by request before your visit.

Vehicle descriptions are provided in good faith and based on information available to us at the time of listing, including CARFAX vehicle history reports. While we strive for accuracy, we do not guarantee that all information is complete or free of errors. You are encouraged to inspect the vehicle in person and verify all details before purchase.

5. Credit Applications

You may submit a credit application online or in person. By submitting an application:

• You authorize Apex Motors to obtain a consumer credit report about you from one or more consumer reporting agencies for the purpose of evaluating your application
• You certify that the information you provide is true and complete
• You understand that we may share your application with our financing partners for the purpose of arranging financing

You may withdraw a credit application before it is processed by contacting us.

6. Vehicle Purchase Agreements

Vehicle purchases are governed by the Retail Installment Contract, Bill of Sale, and any additional documents executed at the time of sale. Those documents, not these website Terms, govern the terms of your purchase.

7. Vehicle History Reports

Apex Motors provides a complimentary CARFAX vehicle history report with the purchase of every vehicle. CARFAX reports are provided by a third party and reflect information reported to CARFAX. We do not guarantee the completeness of CARFAX data. CARFAX does not report all accidents or vehicle events.

8. New Jersey State Inspection Guarantee

Apex Motors guarantees that every vehicle sold from our lot will pass New Jersey State Inspection at the time of sale. Details of this guarantee are provided at the point of sale.

9. Comprehensive Multi-Point Inspection

Each vehicle in our inventory passes a comprehensive multi-point inspection performed by our in-house service department before it is offered for sale. This inspection does not constitute a warranty. Optional Vehicle Service Contracts are available for purchase at the time of sale.

10. Warranties and Disclaimers

Unless otherwise stated in writing at the time of sale, all vehicles are sold as-is, subject to the applicable Federal Trade Commission Buyers Guide posted on each vehicle. Any additional warranty or vehicle service contract will be documented separately and forms a part of your purchase agreement. The website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

11. Limitation of Liability

To the fullest extent permitted by law, Apex Motors will not be liable for any indirect, incidental, consequential, or special damages arising from your use of the website or your interactions with us prior to executing a purchase agreement. This section does not limit any rights you have under New Jersey consumer protection law.

12. Text Messages

Apex Motors may send marketing text messages to customers who have provided their phone number and opted in. You will be asked for permission when you provide your contact information. If you provide your phone number to us, you may receive transactional messages related to your inquiry, purchase, or service appointment. Message and data rates may apply. You can opt out at any time by replying STOP.

Communications and marketing consent

Message frequency varies. Message and data rates may apply, depending on your mobile plan. We do not charge for the messages themselves, but your carrier may. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier and device.

Separately from marketing consent, we may contact you about a transaction or request you started, for example, replying to a question you sent us, confirming a scheduled appointment, or following up on a financing application.
